1. Who can use the Site

In order to use the Preloved Baby's Boutique Site and make purchases, Users must be at least 18 years old and must have the legal authority, right and freedom to enter into a binding agreement according to the Terms below. It is not permitted to use the Site and the services provided for purposes not foreseen by law.

2. How to place a Purchase Order

To place an order on the website www.prelovedbaby.it it is not necessary to register. In fact, the purchase can also be made as a simple visitor. In this case, however, it will not be possible to keep track of the order history.

If there is a desire, registration on the Site can be carried out during the order confirmation phase or by clicking on the "Log in" item located at the top right of the navigation menu. The aforementioned registration will allow the User to provide his contact details, make an appointment, keep track of the "Wish List" and the orders placed.

3. Commercial terms offered to Customers

1. By placing an order on the Site, www.prelovedbaby.it, the Customer declares to act for exclusively private purposes.

2. Each order placed implies the stipulation of a legally binding contract, drawn up in Italian, for the purchase of a product between Preloved Baby's Boutique and the Customer.

3. By clicking on the "Buy" button, the Customer places a binding order for the items contained in the virtual cart.

4. Once the order has been sent, Preloved Baby's Boutique will send the Customer an order confirmation email. The sales contract is considered concluded between Preloved Baby's Boutique and the Customer when the latter receives the Order Confirmation. If the Customer does not receive any Order Confirmation, the relevant order must be considered rejected and, therefore, ineffective.

5. Once prepared, the order can be sent or collected at the Collection Point located in Via Carabinieri Caduti 10 at Spazio Sfera - 20041 – Bussero (MI) based on what was chosen by the Customer during the purchase operations.

6. In the case of shipping, the order will be processed as soon as Preloved Baby's Boutique receives total payment of the purchase price and any shipping costs. It will then be delivered to the chosen courier who will physically deliver it to the address indicated in the shipping address.

7. In case of delivery to the Collection Point, the order will be processed as soon as Preloved Baby's Boutique receives payment of the order price and the Customer will be contacted for collection.

8. Where the products covered by the order are no longer available for reasons beyond the control of Preloved Baby's Boutique, the latter must promptly notify the Customer. In this case, there will be no obligation for Preloved Baby's Boutique to deliver the ordered goods and it will refund, without any delay, in favor of the Customer, any sum already paid.

9. Preloved Baby's Boutique reserves the right not to accept or cancel an order, where it has been sent using software, robots, crawlers, spiders or any automated system or through scripted behavior and any use of third party services, in order to send an order on behalf of the User.

4. Prices, shipping costs and express delivery

1. Product prices are clearly indicated on the Site. Preloved Baby's Boutique reserves the right to modify them at any time, to apply any discounts and to correct errors that may inadvertently occur.

2. The Customer is required to pay the price indicated on the page generated when the order is sent. The price indicated is final and includes VAT.

3. Shipping costs vary based on product parameters and the type of shipping chosen (Standard or Express) and, for orders less than €99.00, are paid by the Customer. Shipping costs are explained to the Customer during the purchase phase. These shipping costs are invoiced by Preloved Baby's Boutique. In the event that the Customer returns the products in accordance with the procedure established by these conditions and applicable legislation, the shipping costs will be refunded.

4. For orders with a value greater than €99.00, shipping costs are paid by Preloved Baby's Boutique.

5. Payment methods

1. Payment can be made by credit card, debit card and Paypal with direct debit or cash (only if on-site collection is chosen).

2. The Customer is responsible for any costs associated with the transaction.

3. The credit card details indicated when placing the order are protected against unauthorized access through the encrypted transfer of data in such a way as to allow secure payment.

6. Use of Promotional Vouchers and Discount Codes

1. Promotional vouchers are offered by Preloved Baby's Boutique as part of promotional campaigns and can be used for a limited period of validity expressly communicated.

2. Promotional vouchers can be used only once and for only one order, no later than the specified validity period. It is possible that for the purchase of some products the possibility of using promotional vouchers is excluded, just as it is possible that the use of vouchers is subject to a minimum spending amount. Vouchers cannot be used to purchase gift cards.

3. The order for which you wish to use the voucher must have a spending amount equal to or greater than the value of the voucher. In case of an amount exceeding the value of the voucher, the difference must be paid via the payment methods above.

4. Promotional vouchers are not refundable for cash and will not be refunded if the buyer decides to return part or all of the products ordered.

5. Promotional vouchers can only be used if the order is finalized, cannot be used retroactively and cannot be transferred to third parties. Unless otherwise provided, it is not possible to combine different promotional vouchers for the same order.

7. Use of Gift Cards

1. Gift Cards can be purchased on the Site and used for the purchase of products offered by Preloved Baby's Boutique, but not for the purchase of further Gift Cards.

2. Gift Cards can be used on multiple orders, until their amount is exhausted. If the total of the purchase order is greater than the value of the Gift Card (original or residual), the difference must be paid via the payment methods above.

3. Gift Cards can only be used before sending the order, they are not refundable in cash and no interest accrues on the credit they represent.

8. Right of Withdrawal

1. As required by current legislation (Consumer Code - Article 52 et seq. of Legislative Decree 206 of 2005), the Customer has the right to withdraw from any order relating to products purchased on the Site, without providing any reason, within 5 days of receipt of the goods by the Customer himself or by a third party designated by him.

2. The right of withdrawal cannot be exercised for all sealed products that are not suitable for return for hygienic reasons and which have been opened after delivery. By way of example, products belonging to this category include diapers, creams and personal hygiene products in general.

3. To exercise the right of withdrawal, the Customer must communicate his intentions clearly and explicitly to Preloved Baby's Boutique. This can be done by sending, within 5 days of receiving the order, directly to Preloved Baby's Boutique, a communication in accordance with the "Withdrawal Methods" below.

9. Withdrawal Method

1. The Customer who wishes to exercise the right of withdrawal can do so by sending an email to ufficio.clienti@prelovedbaby.it detailing the following information:

2. In the event that the Customer has exercised the right of withdrawal, he himself will have to return the purchased products in the state in which they were sent, complete with packaging to the Preloved Baby's Boutique headquarters, by sending them by courier or by direct delivery to the Collection Point (Carabinieri Caduti 10 at Spazio Sfera - 20041 – Bussero MI). In both cases, the methods and timing must be agreed directly with Preloved Baby's Boutique, which will contact the Customer within 2 working days of receiving the Withdrawal Form.

10. Effects of Withdrawal

1. Following the withdrawal, within 30 days of receiving the withdrawal request and the goods, Preloved Baby's Boutique undertakes to carry out the credit transfer for the amount paid during the purchase by the Customer.

2. The refund will be made using the bank details indicated in the withdrawal form.

o In case of failure to indicate the bank details or in case of indication of incorrect bank details, Preloved Baby's Boutique will suspend the refund until the Customer communicates to Preloved Baby's Boutique their correct bank details or PayPal account.

o In case of failure to indicate the bank details and inability to credit the amount to the account since the purchase was made by the Customer as a visitor, Preloved Baby's Boutique will suspend the refund until the Customer communicates his/her Bank account details.

o In case of purchase with gift voucher, Preloved Baby's Boutique will issue a new gift voucher.

3. To obtain a refund, the Customer is required to return the products without undue and unjustified delay and in any case within 14 days from the day on which he communicated his intention to withdraw from the sales contract.

The products correctly packaged in their original packaging, not ruined, damaged or dirty and equipped, if present at the time of the order, with all possible accessories, instructions for use and any documentation. In the event of loss or damage to the packaging, the Customer will have to replace it at his own expense in order to return the products.

6. Products identified as "new" on the Site with a label and without obvious signs of use, other than those compatible with carrying out a normal test of the item.

7. The products identified as "used" on the Site must not bear traces of prolonged use, other than that already previously present and of which the Customer is informed and aware at the time of purchase.

8. The products provided with the transport document, present in the original packaging, in order to allow Preloved Baby's Boutique to identify the Customer and the order placed by him.

9. In the event that the return occurs with an unjustified delay compared to what is specified in the previous point c), the withdrawal will not be effective.

10. In the event that the returned product does not comply with what is clearly prescribed in the previous point d), the withdrawal will not be effective.

11. The costs of returning the goods are borne by Preloved Baby's Boutique provided that the customer uses the documents and methods indicated by Preloved Baby's Boutique. Otherwise, the costs of the return will be charged to the Customer.

12. The Customer is held responsible for any decrease in the value of the products purchased resulting from use and handling that is very different from that relating solely to the need to establish the nature, characteristics and functioning of the products themselves.

11. Guarantee for defects and non-conformities of the products and additional information

1. The provisions of the Consumer Code regarding the Guarantee for Product Defects and Differences apply to purchases of products explicitly presented on the Site as "new" made at Preloved Baby's Boutique. The Customer will therefore be granted the rights referred to in the art. 130 of the Consumer Code and these must be exercised within the terms established by the art. 132 of the same Code.

2. To purchases of products explicitly presented on the Site as "used", since the Customer freely and consciously purchases second-hand products, the provisions of the art. apply. 134 of the Consumer Code and for this reason the Warranty for Defects and Defects is limited to one year from delivery of the product.

3. It is specified that, based on the provisions of current legislation, since the products explicitly presented as "used" are second-hand items, the normal signs of wear connected to the qualification of used products do not constitute either a defect or a discrepancy. Therefore, no warranty rights are foreseen for such signs of wear highlighted in the product description.

12. Direct purchase of products by Preloved Baby's Boutique

1. As a trader of used goods, Preloved Baby's Boutique sells to private individuals items related to the world of childhood previously purchased by other private individuals.

2. From private individuals, Preloved Baby's Boutique only purchases second-hand products, presented on the Site with the wording "used", and new items including labels and packaging, presented on the Site with the wording "new". For both types of items, Preloved Baby's Boutique undertakes to purchase only and exclusively products in excellent condition, clean and working.

3. The items, "new" and "used", are offered to Preloved Baby's Boutique by private individuals who intend to sell products that they no longer use. Once the proposals presented have been evaluated, Preloved Baby's Boutique reserves the right to purchase only the proposed items that meet the above characteristics and that it needs, based on the inventory present in the warehouse.

4. Having examined the items to ascertain their real conditions, Preloved Baby's Boutique offers the owner of the selected goods a quotation based on the condition of each individual product, the brand, the year of production (if in possession of this information), to the average online selling price of the new item - or similar products - indicated on the websites of the brands of the products themselves or on the most famous e-commerce sites, to future commercial opportunities.

5. Once the price has been defined and agreed, Preloved Baby's Boutique proceeds with the purchase of the products which can be paid immediately or within 30-60 days, as required by current legislation, based on the agreements made and signed with the owner of the goods.

6. Once the items have been purchased, they become the property of Preloved Baby's Boutique and the previous owner cannot claim rights or claims over them.

13. Treatment of items purchased by private individuals

1. Once the items have been purchased from private individuals, Preloved Baby's Boutique takes care of their management and treatment, providing, if necessary, to carry out small tailoring restorations or repairs. The items are then sanitized, photographed to be published on the site, packaged and stored at the Preloved Baby's Boutique warehouse.

2. The products purchased can also be used for the production of audio-visual material useful for promoting Preloved Baby's Boutique through the main social channels.

14. Treatment of the audiovisual content of the Site

All the content of the Site www.prelovedbaby.it is the property of Preloved Baby's Boutique, including documents, photographs, images, characters, designs, codes and format scripts. The material contained in the website is protected by copyright according to Law 22 April 1941, n. 633 and subsequent amendments. Any reproduction, alteration, transmission, publication or redistribution to third parties, for commercial purposes, is strictly prohibited without the express written consent provided by Preloved Baby's Boutique.
